Property owner raised the rent and the tenant refused to pay rental increases, arguing the increase violated the city’s rent stabilization ordinance. The owner responded by filing an unlawful detainer action. A provision in the ordinance states that a tenant may refuse to pay rent greater than that allowed under the ordinance. The trial court agreed with the tenant and granted summary judgment, and the appellate court agreed with the trial court. ABCO, LLC v. Eversley (Cal.
