Plaintiff, a citizen of Sudan, alleged he was detained in Pakistan in 2002 by Pakistani security forces acting under the direction of an unknown American official. He claimed he was transferred to United States Military custody, first at Bagram Airfield in Afghanistan and then at Guantanamo Bay. In 2005, it was determined that, while he was still a threat to the U.S., he was eligible to be transferred to Sudan, which he was. In 2010, he filed an action for money damages in federal court against 22 American officials. For various reasons, the district court dismissed all of his claims. The Ninth Circuit concluded there was no subject matter jurisdiction and vacated the district court’s orders, and remanded with instructions to dismiss the action for lack of subject matter jurisdiction.
