Plaintiff is a shelter that rescues animals. Spaying and neutering shelter animals is part of the organization’s mission to reduce the pet overpopulation problem, and is also required by Food and Agriculture Code §30503(a)(1). A dog named Lilly was placed with defendant, but at the time, Lilly was still too sick to be spayed. Defendant agreed that Lilly would be spayed as soon as she was healthy enough. A few months later, defendant informed the shelter she would not be spaying Lilly. The trial court issued an injunction, ordering defendant to have Lilly spayed by a certain date or else return the dog. The Court of Appeal affirmed. Take Me Home Rescue v. Luri (Cal.
